These Terms form a binding agreement between you ("you," "your," or "user") and The Rebel Ghost Hat Company.

2.1 The Rebel Ghost Hat Company is a small hat retailer and custom hat maker operating from Lynchburg, Virginia, USA. We sell custom and ready-made hats, accessories, and related goods through our website at www.rebelghosthc.com.
2.2 Our services include, but are not limited to:
● Online retail orders for ready-made hats and accessories;
● Custom hat orders (made-to-order based on user specifications);
● Appointment scheduling for consultations and fittings;
● Newsletter and marketing email subscriptions; and
● Custom order form submissions and design file uploads.

3.1 You agree to use this Site only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Site complies with all applicable federal, state, and local laws and regulations.
3.2 Prohibited Conduct. You agree that you will not, under any circumstances:

4.2 You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username and password. You agree not to share your login information with any third party.
4.3 You are responsible for all activity that occurs under your account, whether or not authorized by you. If you believe your account has been compromised or accessed without authorization, you must notify us immediately at info@rebelghosthc.com.
4.4 We reserve the right to suspend, disable, or terminate any account that we determine, in our sole discretion, has violated these Terms or that poses a risk to the Company, the Site, or other users.
We make every reasonable effort to accurately describe our products, including colors, materials, dimensions, and construction. However, due to differences in monitor display settings and the handcrafted nature of many of our items, slight variations in color, texture, or appearance may exist between product images and the actual item received. Such variations do not constitute a defect.
(a) Made-to-Order Nature.Custom hat orders are made-to-order based on your individual specifications. Custom orders are subject to additional lead times, which will be communicated to you at the time of order.
(b) License to Use Submitted Content. By submitting a custom order form or uploading design files, images, logos, or other content, you grant The Rebel Ghost Hat Company a limited, non-exclusive, royalty-free license to use, reproduce, and display that content solely for the purpose of fulfilling your order. This license terminates upon completion or cancellation of the order.
(c) Intellectual Property Warranty. You represent and warrant that any content you upload or submit in connection with a custom order — including images, logos, graphics, and designs — does not infringe, violate, or misappropriate any copyright, trademark, patent, trade secret, right of publicity, or other intellectual property or proprietary right of any third party. You assume full and sole liability for any claims, damages, or losses arising from or related to any intellectual property infringement in connection with your custom design submissions.
(d) Cancellation and Refunds. Custom orders may not be cancelled or refunded once production has begun. If you wish to cancel a custom order prior to production commencing, please contact us immediately at info@rebelghosthc.com. The only exception to this policy is if the finished item is materially defective or the error is directly attributable to the Company.
All products are subject to availability. We reserve the right, without liability or prior notice, to limit quantities, discontinue any product or product line, substitute materials of equal or greater quality, or decline to fulfill any order at our sole discretion.
All prices displayed on the Site are in United States Dollars (USD) and are subject to change without notice. The price applicable to your order is the price in effect at the time your order is confirmed. We make every effort to ensure pricing accuracy; however, in the event of a pricing error, we reserve the right to cancel the affected order and notify you accordingly (see Section 6.2).
6.1 Order Acceptance. Submitting an order through the Site constitutes an offer to purchase. An order confirmation email acknowledges receipt of your order but does not constitute acceptance. A binding contract is formed when we ship or otherwise fulfill your order, or when we explicitly confirm acceptance in writing.
6.2 Right to Cancel Orders. We reserve the right to cancel, refuse, or limit any order at any time, for any reason, including but not limited to: suspected fraudulent activity, failure of payment authorization, product unavailability, errors in product descriptions or pricing, or any other reason we deem appropriate. If we cancel your order, we will notify you and issue a full refund of any amount charged.
6.3 Payment Processing. All payments are processed securely through GoDaddy Payments, a third-party payment processor. By completing a purchase on this Site, you agree to comply with GoDaddy Payments' applicable terms and conditions and privacy policy. The Rebel Ghost Hat Company does not store, retain, or have access to your full credit or debit card numbers. Payment information is handled directly and exclusively by GoDaddy Payments.
6.4 Accepted Payment Methods. We accept the payment methods displayed at checkout, as made available through GoDaddy Payments. Accepted methods are subject to change without notice.
6.5 Sales Tax. Applicable sales tax will be calculated and collected on orders where required by Virginia law or the laws of any other applicable jurisdiction. Tax amounts will be displayed at checkout prior to order confirmation.
6.6 Bank and Transaction Fees. The Rebel Ghost Hat Company is not responsible for any fees charged by your financial institution, including but not limited to foreign transaction fees, currency conversion charges, or overdraft fees. Such charges are solely the responsibility of the customer.
7.1 We ship orders within the United States and, where offered, to international destinations. Available shipping destinations will be displayed at checkout.
7.2 We use a variety of carriers, including but not limited to USPS, UPS, FedEx, and similar services, to fulfill shipments. Carrier selection may vary based on your location and the nature of your order.
7.3 All delivery timeframes and shipping estimates provided on the Site or during checkout are estimates only and are not guaranteed. The Company is not responsible for delays caused by the shipping carrier, weather events, customs processing, or other circumstances beyond our control.
7.4 Risk of Loss. Title and risk of loss for all products pass to you upon our delivery of the item to the shipping carrier. Once a package has been accepted by the carrier and a tracking number issued, the carrier bears responsibility for delivery.
7.5 Lost, Stolen, or Damaged Packages. The Rebel Ghost Hat Company is not responsible for packages that are lost, stolen, or damaged after delivery confirmation by the carrier. If your package is lost or damaged in transit, you should file a claim directly with the applicable shipping carrier. We will assist where reasonably possible by providing shipment documentation.
7.6 International Orders. International shipments may be subject to customs duties, import taxes, tariffs, and fees imposed by the destination country. All such charges are the sole responsibility of the customer. We are unable to predict or control these fees and recommend you contact your local customs authority prior to placing an international order.
We accept returns and exchanges on standard (non-custom) items within [30] days of confirmed delivery, provided that the item is in its original, unworn, unwashed condition with all original tags attached and in its original packaging. Items that do not meet these conditions will not be accepted for return.
Custom and made-to-order items are generally non-returnable and non-refundable due to their personalized nature. However, if your custom item arrives with a material defect or the Company made an error in production, please contact us at info@rebelghosthc.com within [7] days of delivery with photos documenting the defect or error. We will work with you to make it right, at our discretion, through repair, replacement, or refund.
All items marked as "Final Sale" or purchased during a clearance event are not eligible for returns, exchanges, or refunds under any circumstances, except as required by applicable law.
To initiate a return or exchange, you must first contact us at info@rebelghosthc.com to obtain authorization. Do not send items back without prior authorization. Unauthorized returns may be refused or returned to sender at the customer's expense.
Original shipping and handling costs are non-refundable unless the return is the result of our error (e.g., wrong item shipped or defective product). Return shipping costs are the responsibility of the customer unless otherwise specified by us.
Approved refunds will be issued to the original payment method used at the time of purchase within [5–10]business days of our receipt and inspection of the returned item. Processing times may vary depending on your financial institution.
9.1 The Site may offer the ability to schedule appointments for custom hat consultations, fittings, or related services. Appointment availability is subject to change without notice.
9.2 Cancellation Policy. If you need to cancel or reschedule an appointment, you must do so at least [48 hours] in advance of the scheduled appointment time. Cancellations made with less than the required notice may result in a cancellation fee or forfeiture of any associated deposit, as applicable. 9.3 We reserve the right to reschedule or cancel any appointment with reasonable prior notice to you. In such cases, no penalty will be assessed to the customer.
9.4 No-Shows. Failure to appear for a scheduled appointment without prior notice constitutes a no-show. No-shows may result in forfeiture of any deposit paid in connection with the appointment and may affect your ability to schedule future appointments.
10.1 All content on this Site — including but not limited to text, photographs, images, illustrations, graphics, logos, hat designs, brand identifiers, the business name "The Rebel Ghost Hat Company," the "Rebel Ghost" mark, and the overall look and feel of the Site — is the exclusive property of The Rebel Ghost Hat Company or its licensors and is protected by the copyright, trademark, trade dress, and intellectual property laws of the United States and applicable international conventions.
10.2 You may not reproduce, copy, publish, distribute, modify, adapt, translate, create derivative works from, publicly display, perform, sell, or otherwise exploit any content from this Site without our express prior written permission.
10.3 Limited Personal Use License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site and its content solely for your own personal, non-commercial use. We will attempt to resolve the matter within thirty (30) days of receiving your notice. This informal resolution requirement does not apply to requests for emergency injunctive or equitable relief.
16.3 Jurisdiction and Venue. If informal resolution is unsuccessful, any legal action, suit, or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts of competent jurisdiction located in Lynchburg, Virginia. You and the Company each irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
16.4 Waiver of Class Action. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING AGAINST THE REBEL GHOST HAT COMPANY.
17.1 The Rebel Ghost Hat Company shall not be held liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by events or circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, floods, fires, earthquakes, pandemics, epidemics, public health emergencies, acts of war or terrorism, government orders or actions, civil unrest, supply chain disruptions, labor strikes, carrier or logistics failures, utility outages, or internet or telecommunications failures.
17.2 In the event of a force majeure event, we will notify you as soon as reasonably practicable and will use commercially reasonable efforts to resume performance as quickly as possible.
18.1 If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, unenforceable, or in conflict with any applicable law or regulation, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall not be affected by the invalidity or unenforceability of any individual provision.
19.1 These Terms, together with our Privacy Policy (available at www.rebelghosthc.com), constitute the entire agreement between you and The Rebel Ghost Hat Company with respect to your use of the Site and our services, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings — whether oral, written, or electronic — relating to the same subject matter.
19.2 No waiver by us of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
